Calming Galaxy — Terms and Conditions

Owner/Operator: Galaxyway AI (“Galaxyway AI”, “we”, “us”, “our”)

Applies to: The Calming Galaxy mobile app (including Google Play testing tracks), and related websites/pages (including tester applications, waitlists, and support pages).

These Terms and Conditions (“Terms”) govern your access to and use of Calming Galaxy (the “App”) and related services (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Who may use Calming Galaxy

You must be able to form a legally binding contract to use the Services.

Children: The Services are intended for a general audience and are not directed to children. Users under 16 may only use the Services with parental responsibility consent and supervision. Parents/guardians are responsible for the child’s use and any charges incurred.

3) Beta / testing disclaimer (important)

If you access Calming Galaxy via a testing track (including closed testing on Google Play), you understand that:

  • Features may change, be removed, or stop working.
  • The Services may be unstable, unavailable, or contain bugs.
  • We may suspend or end testing access at any time.

4) Accounts and security

You may need an account to use some features.

You agree to:

  • Provide accurate information (where requested).
  • Keep your login credentials confidential.
  • Notify us promptly if you suspect unauthorised access.

You are responsible for activity on your account unless caused by our failure to provide reasonable security.

We may suspend or terminate accounts if we reasonably suspect misuse, fraud, security issues, or violations of these Terms.

5) The Calming Galaxy experience

Calming Galaxy provides calming audio experiences (e.g., calming music, albums/collections, Nature Sounds mixing, sleep timer, favourites, playlists, listening history, downloads/offline features where available, and listening stats/achievements). Features may vary by device, region, and subscription status.

We may update, modify, or discontinue any part of the Services at any time (including content availability and feature sets).

6) Health and wellbeing disclaimer (no medical advice)

Calming Galaxy is for relaxation, focus, and sleep support only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition.

If you have a medical concern, sleep disorder, hearing condition, mental health concern, or are in crisis, seek advice from a qualified professional.

Safe listening: Keep volume at safe levels and do not use the App in situations requiring full attention (e.g., driving).

7) Subscriptions, Free tier, and pricing

7.1 Free vs Premium

We may offer:

  • A Free tier (which may include ads).
  • A Premium tier (typically ad-free and may include additional features such as offline access).

7.2 Pricing and promotions

Premium pricing is shown in the App Store/Play Store and may be presented in your local currency, including taxes where applicable. We currently offer two tiers: Free and a yearly subscription (shown in-store). We may offer limited-time promotions, including early-bird discounts (e.g., 25% off), as displayed at the point of purchase.

No trials: Unless explicitly stated in the store listing at the time you purchase, we do not offer free primum trials.

7.3 Billing platform controls

If you purchase a subscription through Google Play, Google processes the payment and controls billing tools. Your purchase is also subject to Google’s terms and policies.

8) Cancellation and refunds

8.1 Cancelling subscriptions

You can cancel a Google Play subscription at any time via the Play Store subscription settings. Google also requires apps selling subscriptions to clearly disclose how users can manage/cancel and provide an easy-to- use online method to cancel (often via a link to Play subscription management). After cancellation, you typically keep access until the end of the current billing period. Google’s general policy is that cancelling does not usually produce a refund for the current period. (Google Help)

8.2 Refunds

Refunds for Google Play purchases are handled according to Google Play’s refund policies and processes, and eligibility can depend on what you bought, when, how you paid, and where you’re located. (Google Help)

Our approach: Except where required by applicable law, or where a refund is granted by the store platform, payments are non-refundable and we do not provide pro-rated refunds for partial periods.

8.3 UK consumer rights (digital content)

Nothing in these Terms limits your statutory consumer rights. UK law provides rights relating to faulty digital content (including rights to repair/replacement and potential price reduction/compensation in certain circumstances). (House of Commons Library)

9) Content, intellectual property, and permitted use

9.1 Our content

All content and materials in Calming Galaxy (including audio tracks, Nature Sounds, artwork, branding, designs, text, and software) are owned by or licensed to Galaxyway AI and are protected by intellectual property laws.

9.2 Your licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial purposes, subject to these Terms.

9.3 Restrictions

You must not (and must not help anyone else to):

  • Copy, reproduce, distribute, publicly perform, or make derivative works from the Services or content except as allowed by law.
  • Reverse engineer, decompile, disassemble, or attempt to extract source code (except where the law permits this and you have complied with legal requirements).
  • Circumvent subscription paywalls or security features.
  • Scrape, harvest, or mass-download content.
  • Use the Services to infringe others’ rights or for unlawful purposes.

10) User feedback and submissions

If you provide feedback, suggestions, bug reports, or other submissions, you grant Galaxyway AI a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, and incorporate that feedback into the Services without compensation, to the extent permitted by law.

11) Acceptable use and conduct

You agree not to misuse the Services, including by:

  • Attempting unauthorised access, disrupting the Services, or introducing malware.
  • Using the Services to harass, abuse, or harm others.
  • Violating any applicable laws or regulations.

We may investigate suspected violations and may suspend or terminate access.

12) Third-party services and app stores

The Services may interact with third-party platforms (e.g., Google Play billing, Google Sign-In, analytics/crash tools). Third-party services are governed by their own terms and policies.

We are not responsible for third-party services, outages, policy changes, or actions taken by app stores (including account actions, refunds, chargebacks, or billing decisions).

13) Availability, changes, and device compatibility

We do not guarantee uninterrupted availability. Maintenance, updates, network issues, or platform changes may cause interruptions.

We may:

  • Add, remove, or change features or content
  • Update pricing (subject to store rules and required notices where applicable)
  • End or suspend the Services (in whole or part)

If a change materially reduces paid features you reasonably rely on, we will take reasonable steps to inform you (often through in-app notices or store notices), subject to platform capabilities.

14) Termination

You may stop using the Services at any time. You should also cancel any subscription through the relevant app store to avoid renewal.

We may suspend or terminate your access if:

  • You materially breach these Terms
  • We must do so to comply with law or platform requirements
  • We reasonably believe your use poses security, legal, or operational risk

Termination does not affect accrued rights/obligations (e.g., payment obligations and applicable clauses that should survive).

15) Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not warrant that:

  • The Services will always be uninterrupted or error-free
  • Content will always be available
  • The Services will meet your specific requirements

Some warranties cannot be excluded under applicable law; nothing in these Terms excludes those.

16) Limitation of liability

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under law

Subject to the above, and to the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages (e.g., loss of profits, loss of data, business interruption).
  • Our total liability relating to the Services is limited to the amount you paid to us (via the app store) for the Services in the 12 months before the event giving rise to the claim, or £0 if you used only the Free tier.

17) Indemnity

If you breach these Terms or misuse the Services, you agree to indemnify and hold harmless Galaxyway AI from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach/ misuse, to the extent permitted by law.

18) Privacy

Your use of the Services is also governed by our Privacy Policy (which explains what we collect, how we use it, and your rights). If these Terms conflict with the Privacy Policy on a data-handling point, the Privacy Policy controls.

19) Governing law and disputes

These Terms are governed by the laws of England and Wales.

Courts of England and Wales have jurisdiction, except where consumer protection laws in your country of residence give you the right to bring proceedings locally.

20) General legal terms

Severability: If any part of these Terms is found unenforceable, the rest remains in effect.

No waiver: Failure to enforce a provision is not a waiver.

Assignment: You may not transfer your rights under these Terms without our consent. We may transfer our rights/obligations as part of a business transfer.

Entire agreement: These Terms (plus the Privacy Policy and any in-app purchase terms shown at checkout) form the entire agreement regarding the Services.
